This Terms and Conditions of Sale (the "Agreement") is an agreement between you and Real Estate Learning Center ("RELC"), the owner and operator of the realestatelc.com website (the "Site"). By ordering any product or service via the Site, you signify your acceptance of this Agreement, as it may be amended or supplemented from time to time. Changes to this Agreement will be effective when posted.

Prices for all items on this site are listed in U.S. dollars.

Credit Card Processing

In order to help combat credit card fraud, RELC uses several techniques. One of these techniques includes doing address verification on transactions in an effort to determine if the billing details are in fact associated with the card number being used. You hereby acknowledge and permit RELC to conduct said address verification. Furthermore, you acknowledge and accept that in the event address verification fails, your credit card company may place a temporary hold on the amount that was declined. Any amounts put on hold as a result of an address verification failure will not be charged - they are simply put on hold by your credit card company temporarily as part of standard credit processing.

You hereby acknowledge that RELC will under no circumstances be held liable for any indirect or direct damages resulting from the billing and/or credit card information that you submit.

Coupon Code Processing

RELC may offer coupon codes to be used for discounts for on-site classes and online classes. The coupons must be typed in correctly and the apply coupon code button must be pushed before the discount will apply. All customers agree that the coupons hold no cash value and no refunds will be issued should the student not use the coupon code correctly before registering.

Refund Policy

If a student decides to terminate enrollment for any renewal classes, he or she must contact RELC in writing (email) no more than 30 days from online registration date in order to obtain a partial refund. There will be 5% automatically deducted from refund as a transaction fee, no exceptions. If a student has completed and received a certificate for any online class, no refund will be issued for any other classes within that purchased package. Students registering for online renewal classes acknowledge they have tried the demo class to verify classes will run correctly on their device.

Waiver and Limitation of Liability

You hereby acknowledge by your use of RELC products/services that your use of the products/services and any reliance upon them is at your sole risk, and that you assume full responsibility for all costs associated with any use in connection with RELC's products/services.

RELC HAS PRICED ITS PRODUCTS/SERVICES UPON THE UNDERSTANDING, AND YOU HEREBY ACKNOWLEDGE THE UNDERSTANDING, THAT RELC WILL NOT BE RESPONSIBLE OR LIABLE FOR ANY FORM OF CONSEQUENTIAL, INCIDENTAL, STATUTORY, PUNITIVE, EXEMPLARY OR INDIRECT DAMAGES OF WHATEVER KIND OR TYPE ARISING FROM ANY TYPE OF COMMERCIAL, BUSINESS, ENVIRONMENTAL, TORT, WARRANTY, CONTRACT, STRICT LIABILITY OR OTHER CAUSES ARISING DIRECTLY OR INDIRECTLY FROM OR IN CONNECTION WITH ANY PRODUCT/SERVICE AND/OR ITS USE, EXCEPT CONSEQUENTIAL DAMAGES FOR ANY INJURY TO A PERSON IN THE CASE OF PRODUCTS PURCHASED FOR CONSUMER USE AS DEFINED BY 15 US C. § 2301.

YOU AGREE NOT TO JOIN IN ANY LAWSUIT WITH ANOTHER PERSON OR SERVE AS A CLASS REPRESENTATIVE OF ANY CLASS ACTION LAWSUIT AGAINST RELC ARISING OUT OF YOUR PURCHASE OR USE OF PRODUCTS/SERVICES ORDERED VIA THE SITE.

Indemnification

YOU AGREE TO DEFEND, INDEMNIFY AND HOLD COMPLETELY HARMLESS RELC FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, COSTS, AND EXPENSES, INCLUDING ATTORNEYS’ FEES, ARISING FROM OR RELATED TO YOUR USE OF THE PRODUCTS/SERVICES PURCHASED VIA THE SITE.

Governing Law and Venue

This Agreement, the entire relationship between you and RELC, and any litigation or other legal proceeding between you and RELC (whether grounded in tort, contract, law or equity) shall be governed by and construed in accordance with the laws of the State of Arizona, without giving effect to its choice of law rules. This contract is fully performable in Maricopa County, Arizona.
